Article 1 : Objet

Les présentes Conditions Générales de Vente (CGV) régissent exclusivement la vente des abonnements payants sur le site LoveKurd.com. En passant commande, l'Utilisateur, qui est un consommateur au sens du Code de la consommation, déclare avoir pris connaissance et accepté sans réserve les présentes CGV ainsi que les Conditions Générales d'Utilisation (CGU).

Article 2 : Packs et Tarifs

Les abonnements proposés sont les suivants :

• 1 mois : 29,99 €
• 3 mois : 19,99 €/mois
• 6 mois : 14,99 €/mois
• 12 mois : 9,99 €/mois

Les prix sont indiqués en euros toutes taxes comprises (TTC). LoveKurd se réserve le droit de modifier ses tarifs. L'Utilisateur sera facturé au tarif en vigueur au moment de sa souscription.

Article 3 : Modalités de souscription

Pour souscrire à un abonnement, l'Utilisateur doit préalablement avoir créé un compte membre sur LoveKurd.com. Il sélectionne ensuite l'abonnement de son choix et valide son paiement.

Article 4 : Paiement

Le paiement est effectué de manière sécurisée en une seule fois, via la plateforme de paiement Stripe. Les cartes bancaires acceptées sont celles couramment utilisées (Carte Bleue, Visa, Mastercard, etc.). La transaction est chiffrée et les coordonnées bancaires de l'Utilisateur ne transitent pas et ne sont pas conservées sur les serveurs de LoveKurd.

Article 5 : Durée, exécution et fin de l'abonnement

5.1 L'abonnement est souscrit pour une durée déterminée (1, 3, 6 ou 12 mois). Il ne se renouvelle pas tacitement. À son expiration, l'accès aux fonctionnalités payants cesse et l'Utilisateur redevient un membre gratuit.

5.2 L'accès aux Services Payants est immédiat après la validation du paiement.

5.3 Conformément aux dispositions de l'article L.221-28 12° du Code de la consommation, l'Utilisateur est informé qu'il ne bénéficie pas du droit de rétractation pour la fourniture d'un contenu numérique non préconditionné, dès lors que l'exécution a commencé avec son accord exprès. En validant son achat, l'Utilisateur reconnaît et accepte expressément que le service commence immédiatement et renonce à son droit de rétractation.

Article 6 : Responsabilité de LoveKurd

LoveKurd s'engage à fournir le service avec diligence et selon les règles de l'art. Sa responsabilité ne saurait être engagée en cas d'interruption temporaire du site pour des opérations de maintenance, de force majeure, ou en cas d'utilisation non conforme ou abusive du service par l'Utilisateur.

Article 7 : Propriété intellectuelle

L'Utilisateur s'engage à ne pas reproduire, copier ou exploiter tout élément du site LoveKurd.com (textes, images, logos, base de données) à des fins commerciales ou personnelles sans autorisation préalable écrite de LoveKurd.

Article 8 : Données personnelles

Les données personnelles collectées pour la vente sont traitées par Stripe pour le paiement et par LoveKurd pour la gestion de l'abonnement. Conformément au RGPD, l'Utilisateur dispose d'un droit d'accès, de rectification et d'effacement sur ses données. Pour toute demande, contactez-nous à contact@lovekurd.com. Article 9 : Réclamations et médiation

Pour toute réclamation, l'Utilisateur peut nous contacter à l'adresse : contact@lovekurd.com. Nous nous engageons à apporter une réponse le plus rapidement possible. Conformément au Code de la consommation, le consommateur a le droit de recourir gratuitement à un médiateur de la consommation en cas de litige non résolu avec LoveKurd.

Article 10 : Droit applicable et litiges

Les présentes CGV sont régies par le droit français. En cas de litige, et après une tentative de résolution amiable, le consommateur peut saisir, les tribunaux français.

Preamble

These General Terms of Use (GTU) are concluded between the publisher of the LoveKurd.com website, hereinafter referred to as "LoveKurd", and any person registered on the site, having the status of Member or Subscriber, hereinafter referred to as "the User".

By creating an account, the User declares that they have read and unreservedly accepted these GTU, as well as our Privacy Policy. Any access to or use of the site implies compliance with this contract.

Article 1: Definitions

• Subscription: A paid commitment granting access to the Paid Services for a fixed, non-tacitly renewable period.
• Subscriber: A User who has taken out a Subscription.
• Member: A User registered free of charge on the Site.
• Profile: The User's personal space containing their description, photos, and videos.
• Account: A personal and secure interface allowing access to the Services.
• Services: All functionalities accessible via the Site.
• Paid Services: Services exclusively reserved for Subscribers.
• Site: The LoveKurd.com website.
• User: Refers interchangeably to a Member or a Subscriber.

Article 2: Access and Registration

2.1 Registration is free, reserved for adults (18 years and over), and requires providing accurate and sincere information.

2.2 The User agrees to comply with these GTU and applicable laws. Any breach may result in the immediate suspension or termination of the Account by LoveKurd, without prejudice to any other legal action.

2.3 Subscriptions are taken out for a fixed period (1, 3, 6, or 12 months). Upon expiration of the Subscription, the User reverts to a Member with free functionalities. No automatic renewal is performed.

Article 3: Service Functionalities

3.1 Free functionalities (Member)

Profile creation, basic search, viewing Profiles, registration for events.

3.2 Paid functionalities (Subscriber)

Full access to messaging and all premium functionalities described on the Site for the duration of the Subscription.

Article 4: Commitments of the Parties

4.1 Commitments of LoveKurd

LoveKurd undertakes to implement all means to ensure the continuity and security of the Service. LoveKurd is a connection service and cannot in any way guarantee meetings between Users, nor verify the accuracy of the identity declared by each user.

4.2 Commitments of the User

The User agrees to:

• Adopt respectful and lawful behavior.
• Not disclose their personal contact details (address, phone number, email, social media) on their public profile.
• Not publish illicit, hateful, pornographic, violent content or content infringing on the rights of others (image rights, intellectual property).
• Not impersonate a third party, harass other Users, or attempt to harm the operation of the Site.

The User is solely responsible for the content they publish and the interactions they initiate.

Article 5: Prices and Payment

The current Subscription prices are as follows:

• 1 month: €29.99
• 3 months: €19.99/month
• 6 months: €14.99/month
• 12 months: €9.99/month

Payment is secure and made in one go via our provider Stripe. In accordance with Article L.221-28 of the French Consumer Code, no refund will be granted after access to the Paid Services has begun, except in the case of a technical error attributable to LoveKurd that completely prevents its use.

Article 6: Intellectual Property

The User retains all rights to the content (texts, photos) they publish on their Profile. By publishing this content, they grant LoveKurd the license strictly necessary to host and display their Profile solely within the framework of the Site's operation and the provision of the Services. LoveKurd shall in no case have the right to reuse, distribute, or exploit this content outside the LoveKurd.com platform for advertising or commercial purposes.

Article 7: Liability

The User is responsible for the configuration of their equipment and their internet connection. LoveKurd cannot be held liable for indirect damages or malfunctions related to external circumstances (force majeure, internet network). LoveKurd's liability is strictly limited to the provision of the connection platform.

Article 8: Suspension and Deletion of Account

The User can permanently delete their Account at any time from the "My Account" section. This deletion is irreversible.

LoveKurd reserves the right to suspend or terminate any Account immediately in the event of a breach of these GTU, without prior notice or compensation.

Article 9: Personal Data

Users' personal data is processed in accordance with our Privacy Policy, which explains how we collect, use, and protect it. The User is encouraged to read it.

Article 10: Disputes and Governing Law

These GTU are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the French courts shall have exclusive jurisdiction.

Article 11: Evolution of the GTU

LoveKurd reserves the right to modify these GTU for technical, legal, or service evolution reasons. The current version is the one accessible online on the Site. Users are invited to consult it regularly. Continued use of the Service after any modification constitutes acceptance of the new GTU.
